Democracy under Attack 13th of June, 2012
Despite democratic principles United States was founded for, democracy is in despair. I directly observe and record this by field work in Orange County, California – my focus of anthropological study, as was taken over by Donald Bren through Irvine Co. I spent 7 years researching modern culture, archaeology, books, and ethnographic record about the 211 year power transformation since settlement. I analyze the American Dream’s resulting now 40 year decline.
Our country was established with a Constitution guaranteeing Rights to people living here. Yet, these are increasingly disregarded through legal distortion. Now whole counties like Orange and communities therein are held hostage by those disregarding supreme law and unlawfully dominating the populace. Many who are supposed to be good role models are instead dishonorable examples. This has lead social institutions and individuals to have a lack of honor. We the People of the United States must be allowed our Right of representational government to prevent otherwise eminent chaos.
The Declaration of Independence begins by acknowledging if real justice is not served, it becomes necessary to dissolve unjust political bands. Then, our country was under exploitative control. Thus, John Hancock needed to make it clear: “All men are created Equal, [and] are endowed by their creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.” President Thomas Jefferson worked to prohibit monopolies since they lead to tyrannical usurpation of power (Vile, 1996: 210). Our liberation from oppression then was similar to domination going on now.
Oppression now occurs through unequal representation of money. According to the Constitution, all legislative powers are vested in the congresses, elected by the People: who are all ensured equal representation. Further, the 12th Amendment established the Executive Branch as elected by an Electoral College representing the people and not swayed by other influences. Articles include a Judicial Branch as a check to make sure balance is for the people, not money.
U.S. government has evolved to be not representational. Freedom of speech is our guaranteed 1st Amendment Right. Supreme Court trial Buckley v. Valeo (1974) decided now, money is needed for political speech. The ruling determined there be individual contribution limitations but that special interests can represent themselves through huge amounts of Political Action Committee (PAC) funding (Friendly, 1984: 105). Yet, those with little money are still guaranteed representation! Due to lack of funds now most people are not represented in the current political system, so we do not have real democracy.
This is exactly why President Jefferson worked to ban the monopoly's social control. A monopoly is a system of tyranny. One person, as with Orange County’s dominator: Donald Bren of Irvine Company, controls all different people and communities in multiple cities. Now, this domination is growing to include the rest of the county and many other parts of California – and national cities, as now expanded to Chicago. When a monopoly takes control, everyone is at the monopoly’s whims since it controls everything. Monopolies are therefore banned by the Sherman and Clayton Acts: Sherman Act § 1, 15 U.S.C.A. § 1; Clayton Act § 15 U.S.C.A § 18.
Monopolies limit access to work, resources for life, and housing. Many are not allowed the means to advance themselves so instead are left on the streets to expire. They are not legally allowed to belong anywhere and do not have the means to even apply for a job to get off the streets because of now mandatory technological advances – limiting independence (Len, 2012).
Our streets have become an ‘illegal’ wasteland of people called “undesirables” who are deserted by society. Many of these people were formerly able but were forced into bankruptcy and had no way to return. Also, mentally disabled and incapacitated people not able to take care of themselves have been kicked out of mental wards and have nowhere to go. Given no purpose, sane (driven crazy) and insane will retaliate back on the powers giving them no hope, who they feel forced them to give up on themselves. WE MUST PREVENT ANARCHY!
When in the Course of human events it becomes necessary to make change so as to prevent revolution against a good system corrupted by some bad people misguiding the good, we must make the necessary changes to avert disorder. Donald Bren of Irvine Company is essentially the same as the monarchy we freed ourselves from on Independence Day to establish democracy. There are no collaborative decisions. These are replaced by total control and democracy becomes a façade. Due process is required to prevent change by force.
Many people part of our society who toil tirelessly doing essential labor most others do not wish to do are not allowed any way to be naturalized. Martín Baro brought out how socialization makes a personal identity enforced by symbols of the state (1994: 76, 77). Most come here as refugees from corruption which has overrun every sphere of life in Mexico. As such, these immigrants are protected by the Refugee Act (1980) (Friendly, 1984: 239). Yet, personal identities called “illegal” keep people separate and unequal without due process.
Chief Justice Brennan acknowledged, “this situation... [makes] a permanent caste of undocumented resident aliens encouraged by some to remain here as a source of cheap labor but nonetheless denied benefits our society makes available to citizens and lawful residents” (Friendly, 1984: 244). This state of “illegality” turns people into a disposable commodity – used for cheap labor whose rights are stolen by threats of deportation (DeGenova, 2007: 214). Current law makes no process for naturalization to toiling refugees who cannot safely go home.
These people are deprived liberty and property and have no process made by law. Therefore, the 5th and 14th Amendments, guaranteeing all people these rights and that law make due process for all people living within the jurisdiction of this country, are broken. By not being allowed Rights guaranteed All People in the United States Constitution, they therefore are used almost as slave labor which is banned by the 13th Amendment in no representation. When disenfranchised people are allowed constitutionally protected due process naturalization, money's corrupt influence will lose power and the People's actual needs will be represented.
All society is held hostage to the monopoly at every level. When it has control of entire commercial and much residential lands needed for people’s lives, then businesses, tenants, and people are forced to do the monopoly’s bidding to prevent retaliation. Courts are even deceived through money and lies to make things appear legitimate and keep real Justice Power from the people. Through this usurpation of power, all the principles of democracy we are supposed to and continue to pretend to stand for are overthrown.
Although democracy is in a state of turmoil, the just government of our Union is still in effect and was founded to take care of these problems. Our institutions overall maintain their integrity even if some have begun to corrupt them. Stop those who are degrading and destroying our system before they turn US into chaos. Those who have been corrupted, Stop and make things right before you make things worse for everyone including yourself.
We are all part of society together and if many of the people cannot get by, it will negatively affect the rest of us. Let’s actually fix things like they attempted to do before the Great Depression trying to pass the never adopted Corporate Practices Act of 1925 leading to the biggest economic catastrophe in U.S. history (Friendly, 1984: 96). We must free ourselves from the suppressive tyranny before it is too late and we have another Great Depression.
As evidenced, the current situation of power does not represent the consensus’ social needs. If we as a country of the United States do not begin to do this and stand behind the very Constitutional Rights we are supposed to be governed by, we as a society will be overthrown. People will channel their energies towards basic needs of representation as our society's members are guaranteed (Martín-Baro, 1994: 83). Then, we will likely lose many of the beautiful advances we made in social evolution.
The American Dream is in decline but we need to do what is right to save it. As even admits the Advising & Defending Corp. Directors handbook:
“Federal and state lawmakers enacted special provisions to protect whistle blowers and punish those who retaliate against them for their [remedial] activities” (692). Further, “Both corporation and the individual can be convicted of the same crime” (657). If we don’t each do our part to correct things, then it will come back to haunt us; for some worse than others.
After finishing this positive discourse in Public Defense to uphold our country's legitimacy, I had several educated people read this to give me feedback to use with fieldwork and research for an even more informed conclusion. One was a USC graduate woman now working in the corporate world and the other is a very knowledgeable man working as a software developer from one of the oldest orders in our country that helped inspire our constitution.
As the woman suggested, we need facts. People, tell what you know. You are not a tattle-tale if the cat is a financial serial killer. Then, you are a hero. As the man suggested, the consensus needs something to do! So let’s use American Choice Power and boycott the oppressing tyrant. Then, we will suffocate it (without money) and everyone else will finally eat.

In "Democracy Under Attack" I wrote about the American Dream's decline from power's disregarding Constitution and forgetting Declaration of Independence's meaning. This is by money exploitation, people being deserted by society, and by immigration abuse,
illegally calling people illegal and prohibiting due process for suppression.
After I submitted this to the U.S. Federal Court and asked that they pass it up as high as possible, I received a text at 5:00 AM the next morning from a number I never heard from again that "President Obama grants amnesty to DREAMERs, text him your thanks!" (which I definitely did.) DREAMERs, of the DREAM Act (that we - many led by Senator Cedillo supporting equality for US to work together for US to grow by all members' contributions - have promoted for years towards this, myself for 3 years), are part of our society and have been their whole lives as long as they can remember. They do contribute and must be treated equally.
President Obama's action is a solution for True Democratic Representation.
